TERMS OF USE AGREEMENT

Welcome to 3CLICK INC.!

The following material governs the use of this application. By clicking the “YES” or “I AGREE” button, YOU (the “User”) agree to all the provisions under this Terms of Use Agreement. By continuing to use the application, YOU certify that you have read, understood, and accepted all provisions below, that you are of legal age, not a robot, and are under no legal impediment.

1. AGREEMENT

This Terms of Use Agreement (“Agreement”) constitutes a legally binding contract between YOU (the “User”) and 3Click Inc. (the “Company,” “Website,” “3Click Inc.”). By accessing our website or using the application, the User agrees to be bound by these terms and to use the website at their own risk, including the processing of personal information (PI) or sensitive personal information (SPI) by 3Click Inc.

3Click Inc. reserves the right to update this Terms of Use Agreement as required by legal or regulatory changes or to improve the functionality of the website. Continued use of the website after updates constitutes acceptance of the modified terms.

If the User does not agree to these terms, they must not continue using the website.

2. SERVICE DISCLAIMER

3Click Inc. is solely a digital platform that connects service providers with service seekers. The Company is not involved in any of the actual service activities, work arrangements, or financial transactions between Users. All interactions, agreements, and transactions between service providers and service seekers are conducted at their own risk and discretion.

3Click Inc. does not handle, process, or refund any money exchanged between Users. Users must exercise caution and verify the legitimacy of any offers before making payments or entering into agreements.

As this is a new platform, Users may experience a limited number of available service providers. We are actively working to onboard more service providers to improve the platform’s efficiency. We appreciate your patience and support.

IMPORTANT NOTICE: Before availing or providing any service, Users must verify all information from their end. This is particularly important when hiring caregivers, household helpers, or any other service provider. 3Click Inc. does not verify, endorse, or guarantee any service provider’s qualifications or legitimacy. Users are responsible for conducting their own due diligence before engaging in any service-related transactions.

3. USER RIGHTS AND RESPONSIBILITIES

3.1 Limited License

3Click Inc. grants the User a limited, revocable, non-exclusive right to access and use the website solely for legitimate purposes, including:

  • Inquiring about 3Click Inc.’s services
  • Searching for service providers
  • Offering services
  • General informational browsing

3.2 Prohibited Uses

Users may not use the website for:

  1. Posting libelous, harassing, threatening, obscene, or otherwise objectionable content in violation of any applicable laws.
  2. Copying, duplicating, or reproducing website content without authorization.
  3. Intentionally interfering with other Users’ access to the website.
  4. Storing copies of website materials without permission.
  5. Transmitting materials that promote illegal activities.

Additionally, Users must not:

  • Violate or attempt to violate website security
  • Reverse-engineer any part of the website
  • Impersonate another person
  • Post false or misleading information (e.g., fake service listings or credentials)
  • Disrupt website functionality
  • Send unsolicited communications (spam, fraud, phishing attempts)
  • Engage in discrimination, hate speech, or offensive conduct

Violations of these terms may result in termination of access and legal action.

Special Note to Consultancies and Third Parties: Consultancies, agencies, or third-party businesses may not use any information obtained from the platform for their customers, business operations, or any other unauthorized purposes. Any misuse of data, including unauthorized access, sharing, or exploitation of Users' information, is strictly prohibited and may result in legal action. 3Click Inc. does not take responsibility for any unauthorized use of data by third parties.

USER DATA PROTECTION AND PRIVACY

3Click Inc. respects Users' privacy and processes personal data in accordance with Republic Act No. 10173 (Data Privacy Act of 2012). Data collection, processing, retention, and disposal comply with principles of transparency, legitimate purpose, and proportionality.

4.1 Information Collected

Subscribed Service Providers:

  • Business name (registered with SEC/DTI or full name if unregistered)
  • Business and residential address
  • Contact information
  • Service listings and requirements

Subscribed Service Seekers:

  • Full name (including middle name)
  • Residential address
  • Date of birth, nationality, and religious affiliation
  • Service needs and requirements
  • Government-issued ID and a recent photo

4.2 Purpose of Data Collection

  • Facilitate service matching
  • Verify User identity
  • Improve service functionality

4.3 Data Sharing

User data may be shared between subscribed service providers and service seekers as necessary for service transactions, subject to explicit consent agreements.

4.4 User Rights

Users have the right to:

  1. Be informed about data collection
  2. Object to processing
  3. Access their data
  4. Correct inaccurate information
  5. Request data deletion
  6. File complaints regarding data misuse
  7. Seek compensation for data breaches
  8. Data portability
  1. INTELLECTUAL PROPERTY

All content, trademarks, and intellectual property associated with 3Click Inc. remain the exclusive property of the Company. Unauthorized reproduction, modification, or distribution of content is strictly prohibited.

Users may:

  • Display 3Click Inc. content on personal devices
  • Store content for personal, non-commercial use

Users may NOT:

  • Modify, copy, distribute, or commercially exploit website materials
  • Use website content without written authorization

6. WEBSITE AVAILABILITY & LIABILITY LIMITATIONS

3Click Inc. strives to provide uninterrupted service but does not guarantee that the website will be error-free. Users may experience downtime due to maintenance, technical issues, or updates.

Users should report technical faults to 3Click Inc., and the Company will attempt to resolve issues promptly.

3Click Inc. does not guarantee the availability or accuracy of service listings posted on the website. Users are responsible for verifying service listings before engaging with providers.

3Click Inc. is not responsible for:

  • Losses resulting from website outages or errors
  • Unauthorized access or security breaches beyond its control
  • User-provided misinformation
  • Third-party actions (e.g., fraud, service scams, or false advertisements)

Users assume all risks associated with using the website.

7. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by the laws of the Republic of the Philippines. Any disputes shall be settled through arbitration or mediation before resorting to litigation.

8. CHANGES TO THE AGREEMENT

3Click Inc. reserves the right to modify these terms at any time. Users will be notified of significant changes, and continued use of the website implies acceptance of the updated terms.
